This privacy policy sets out how Setec Security Technologies, Inc. (“Setec”, “we”, “us”) uses and protects any information preserved, collected, or received while providing services to our clients. Setec Security Technologies, Inc. is committed to ensuring that our clients’ privacy is protected.

What we collect

Setec Security Technologies, Inc. provides computer forensic and electronic discovery support services. At the request of our clients, Setec Security Technologies, Inc. preserves data from client computer systems, servers, email accounts, online storage repositories, and other digital media sources to enable the delivery of our services. This data may include personal information.

Setec Security Technologies, Inc. may collect individual information including, but not limited to a first name, last name, physical address, an e-mail address, or other contact information. In general, you may visit Setec's web pages without telling us who you are or revealing any personal information about yourself.

Setec Security Technologies, Inc. acknowledges that EU individuals have the right to access the personal information that we maintain about them. An EU individual who seeks access, or who seeks to correct, amend, or delete inaccurate data, should direct his query to privacy@setecinvestigations.com. If requested to remove data, we will respond within a reasonable timeframe.

What we do with the information we gather

The data collected in the course of supporting our clients is subjected to computer forensic analysis, keyword searches, data filtering, and culling in accordance with our client’s instructions. Setec Security Technologies, Inc. will not use our clients’ information except as specifically instructed by the client, or as may be required by law, regulatory authority or court order. We may also be required to disclose an individual’s personal information in response to a lawful request by public authorities, including to meet national security or law enforcement requirements. If we ever were to engage in any onward transfers of client data with third parties other than our agents, we would provide the client with an opt-out choice to limit the use and disclosure of your personal data.

In cases of onward transfer to third parties, we do not disclose personal information to any third party except as specifically instructed by the client, or as may be required by law, regulatory authority or court order. Examples of third parties that frequently receive our client’s data are our client’s counsel and electronic discovery vendors engaged by our clients in conjunction with the legal matters in which we are engaged.

In cases of onward transfer to third parties of data of EU, UK, or Swiss individuals received pursuant to the DPF, Setec Security Technologies, Inc. is potentially liable.

We are committed to ensuring that our clients’ information is secure. In order to prevent unauthorized access or disclosure we have put in place suitable electronic and managerial procedures to safeguard and secure the information we collect.

U-U.S. Data Privacy Framework (EU-U.S. DPF)

Setec Security Technologies, Inc. complies with the EU-U.S. Data Privacy Framework (EU-U.S. DPF), the UK Extension to the EU-U.S. DPF, and the Swiss-U.S. Data Privacy Framework (Swiss-U.S. DPF) as set forth by the U.S. Department of Commerce. Setec Security Technologies, Inc. has certified to the U.S. Department of Commerce that it adheres to the EU-U.S. Data Privacy Framework Principles (EU-U.S. DPF Principles) with regard to the processing of personal data received from the European Union in reliance on the EU-U.S. DPF and from the United Kingdom (and Gibraltar) in reliance on the UK Extension to the EU-U.S. DPF. Setec Security Technologies, Inc. has certified to the U.S. Department of Commerce that it adheres to the Swiss-U.S. Data Privacy Framework Principles (Swiss-U.S. DPF Principles) with regard to the processing of personal data received from Switzerland in reliance on the Swiss-U.S. DPF. If there is any conflict between the terms in this privacy policy and the EU-U.S. DPF Principles and/or the Swiss-U.S. DPF Principles, the Principles shall govern. In compliance with the EU-U.S. Data Privacy Framework (EU-U.S. DPF), the UK Extension to the EU-U.S. DPF, and the Swiss-U.S. Data Privacy Framework (Swiss-U.S. DPF), Setec Security Technologies, Inc. commits to resolve complaints about our collection or use of your personal information transferred to the U.S. pursuant to the EU-U.S. DPF, the UK extension to the EU-U.S. DPF, and the Swiss-U.S. DPF. EU, UK, and Swiss individuals with inquiries or complaints should first contact Setec Security Technologies, Inc. / privacy@setecinvestigations.com / (323) 939-5598.

Setec Security Technologies, Inc. has further committed to refer unresolved DPF Principles-related complaints to a U.S.-based independent dispute resolution mechanism, BBB NATIONAL PROGRAMS. If you do not receive timely acknowledgment of your complaint, or if your complaint is not satisfactorily addressed, please visit www.bbbprograms.org/dpf-complaints for more information and to file a complaint. This service is provided free of charge to you.
